There is NO basis for first degree manslaughter in this case.

Following the statute, in order for first degree manslaughter to apply, the actor must do any of the following (references to paragraphs) :
(1) Intentionally cause the death of another...
(2) in committing or attempting to commit a misdemeanor ..
(3) Intentional causes the death of another ...
(4) Unlawfully (dealing with) a controlled substance
(5) malicious punishment of a child...

“intentionally” means the actor did the act under their own power versus something like dropping the gun and it went off.

That’s the way I see it too. I wonder if the judge has the power - and the guts - to throw that conviction out.
