They should be required to have a warrant to search for compliance.


I’ve never heard of health inspectors requiring a warrant to enter a restaurant. I think if the restaurant refuses them entry, they simply shut it down.

Except this is not checking the cleanliness and safety of the food service. This is searching for evidence of another “crime” not under the focus of their enforcement authority.

Don’t know about NY but in Texas a business owner can require an administrative warrant be issued. I don’t think it was common but I could see it becoming so as government intrusiveness continues.
