This has been going on since FDRs time.
The Dems have had years to enact abortion legislation when they controlled both executive and legislative branch (Carter, Clinton, Obama). Each time they did not do so. It isn’t the courts job to legislate.

The same is true for gun control and any other liberal hot button issue. I suspect the reason they never did so is because the sitting politicians are aware that the liberal hot button issues would get them fired if they really acted on them. Those hot button issues are so far away from the desires of middle America that middle America would revolt at the ballot box if they were enacted. Therefore, Congress passes off the problem to the courts.
The issue we have now is that many members of Congress live in and believe what they see in the Twitterverse. That, however, is not the real world.
