Flynn had previously made several statements under oath. In his affidavit in support of withdrawing his plea, he said he lied when he made those statements. That is perjury.
Powell was incompetent when she advised Flynn to make that admission.
But her entire representation of Flynn was incompetent for more reasons than that.
She was saved when Trump pardoned Flynn.
There is so much more from a legal perspective about this case, none of it a credit to Powell. To say she was incompetent is in fact charitable to her.
BTW, The Federalist apologist for Powell, in the apologist’s articles on the case, also never addressed the specific legal issues raised by Powell. The writer had been a judge’s clerk without appellate experience or an understanding of the issues.
This is what confuses me:
Didn’t Flynn plead guilty to a fabricated charge of lying to the FIB? Wasn’t it another (corrupt) Washington firm that advised him to do that?
Didn’t Trump have to intervene because Emmet Sullivan defied a Justice Department directive?
How do you fight a corrupt FIB and DC Judiciary anyway? How does debating legal minutia work when there is no law left, just a labyrinth of worm-holes?
