Joe Manchin Does It Again
PJ Media ^ | 12/3/21 | Rick Moran

Posted on 12/03/2021 4:04:32 PM PST by Persevero

Senator Joe Manchin announced he would join all 50 Republicans in the Senate in voting for a resolution of disapproval that would roll back the OSHA vaccine mandate. The Congressional Review Act (CRA) allows for a majority of Congress to disapprove of any agency rule. Since the CRA vote is in the form of a resolution, only a simple majority is needed in the Senate to pass it. The CRA would still have to be approved in the House where several Democrats have said they’re considering voting for it. And even if it’s passed by both chambers, Biden would almost certainly veto it.

Maybe it wouldn't be veto proof? Still, hopeful.

I thought that these resolutions of disapproval of regulations didn’t need a Presidential approval.

It would give ammunition in the court fight if it can pass, regardless if Xiden vetos.

“Judge, Congress has just expressly rejected this expansive mandate.”

For a regulation to be invalidated under the CRA, the Congressional resolution of disapproval must be either signed by the President or passed over the President’s veto by two thirds of both Houses of Congress.

If Manchin were serious, he’d switch parties. And if he truly wanted to represent his constituents, he’d switch parties. But if he switched parties, he’d lose his power as chief Senate arbiter.

So it’s not about principle, it’s about power. Just another swamp rat. Don’t trust this guy.

I respectfully disagree. This guy is driving the dems bat**** crazy. He has almost singlehandedly stopped their agenda. Inspired conservatives in denocrats clothing can do that. While their gop counterparts roll over and show their soft bellies on demand.

Unelected bureaucrats can’t write laws. Period. Exclamation point! Only Congress may write laws. This BS that Congress can give away its law-making authority to unaccountable bureaucrats is BS. Don’t believe me? Go read what the Constitution says.

What are the chances that a RINO takes his place in voting with the Dems though?

While I agree with you about driving the left even more insane, the fact is that we are still heading toward a fiscal cliff on federal debt and Shoeless Joe Manchin is ultimately just as accountable for it as Pocahontas or any of the other fruits and nuts in the Senate.

You mean like declaring war? I think the last time that happened was December 11, 1941. Since then, it has sold it’s legacy for a bowl of soup, allowing the executive branch to engage in hostilities everywhere with continuing resolutions.
