Pollak: Joe Biden Can Be Sued for Defaming Kyle Rittenhouse

President Joe Biden could face a civil defamation suit from newly-acquitted Kyle Rittenhouse for calling him a “white supremacist” last year — without evidence, and before Biden was able to enjoy the immunities of presidential office.

Rittenhouse was, by then, a “public figure” for the purposes of defamation law, and would have to show that any defendant acted with “actual malice” — that is, with reckless disregard for the truth. He could arguably do so for Biden’s false statement.

When Biden made the now-infamous, and false, claim about Rittenhouse at the end of last September, more than a month had gone by since the Aug. 25, 2020 shootings for which Rittenhouse had been charged within days. Even then it was clear that no evidence existed to substantiate the media’s initial claim that he was a “white supremacist” — a claim his legal counsel at the time denied on Aug. 28, 2020, and reiterated in a subsequent interview with Breitbart News Sunday on SiriusXM Patriot 125.

Typically, presidents are immune from civil lawsuits for torts alleged to have taken place during their time in office. But as the infamous case of Paula Jones’s sexual harassment lawsuit against President Bill Clinton showed, presidents are not immune from suit for torts committed prior to their taking office. Biden could therefore be sued by Rittenhouse...

We agree on that. It was never my intention to argue the facts of current legal precedence. The decisions I listed, plus Roe v Wade and Robert’s tortured reasoning on Obamacare are routinely criticized on this forum, yet their legality remain.

Thanks. All the deep state Trump haters in the DOJ never forced Trump to testify, so a lawsuit against Biden would involve Biden's lawyers, not the Big Guy himself, right? If there ever was a monetary award to Rittenhouse, seems like there are rich leftists, not Biden, who would pay it. But it could make Rittenhouse wealthy and I would like to see the media coverage if that happened.

But I would also like to see the lying media punished.

POTUS is not immune from civil lawsuit. “It depends” (immunity) on whether the act is an official act. Kennedy was sued for car accident.

Paula Jones sued Bill Clinton for sexual harassment. POTUS said he was immune while he was POTUS - asked for a pause or stay in the case. SCOTUS ended up being the decider in Clinton v. Jones. Clinton lost the “delay” suit, and settled the harassment suit.

No need for Biden to be mentally fit to decide a defamation case. The words speak for themselves, and aren’t sarcasm or parody.

I don’t think that’s possible. IIRC, when there were discussions about possible pardons by Trump, we learned the President only had power to pardon people convicted of Federal crimes.

Joe The Perv wouldn’t be able to pardon Rittenhouse if he had been found guilty because it wasn’t a Federal case. And civil suits — not a chance.

I may be wrong, but I believe that’s what was reported.

I guess that you have a relatively short memory. This has nothing to do with the bogus attacks on President Trump. Do you remember when Clinton was sued by Paula Jones while he was president? He was forced to give a deposition. And he made an a$$ out of himself denying that he couldn't remember anything about her or their infamous encounter. Clinton eventually settled with her for $850,000 after he was caught lying under oath during the deposition about various matters including his relationship with Monica Lewinsky. This of course led to such meaningful quotes as, “It depends on what the meaning of the word is, is.” Along with Clinton then lying to the public, “I did not have sexual relations with that woman, Miss Lewinsky.” which of course he later was forced to confess that he did.

Of course Biden's attacks and slanderous remarks about Kyle Rittenhouse are all on video that I am sure are currently being purged from YouTube and all the major media outlets, but believe me the lawyers already have them all. He is toast on this one and will not only be paying out for slandering an innocent kid, but he will have to do at the least a taped deposition without benefit of a teleprompter or written notes. Won't that be a picnic for the evil senile old goat?

I agree that the attacks on Trump were absolutely bogus, and yet in a way, they were successful. The liars kept them going for years and had millions brainwashed. The deep state has been reinforcing its grip on the DOJ, FBI, etc. for decades, and they are more brazen than ever. I really hope Biden gets sued to kingdom come, but I am not sure what would happen. Clapper and Brennan should have been charged too.

There are still political prisoners in DC, forced to say they renounce their beliefs Soviet style. Biden deserves to pay for his slander against Rittenhouse, but will he?
