Joe Biden’s vaccine mandate on private businesses with a hundred or more employees has been blocked by the courts—twice.
OSHA has suspended enforcement of the vaccine mandate.
But, this is not stopping the White House from moving forward with the mandate anyway. In fact, Joe Biden is still encouraging businesses to take the steps necessary to implement it.
“OSHA suspended the vaccine implementation and enforcement because of a court order. Given this update, is the administration still urging businesses to move forward with the president’s vaccine and weekly testing rule?” a reporter asked White House Press Secretary Jen Psaki on Thursday. “And are you still working off of that January 4th compliance deadline?”
“Let me be very clear: Our message to businesses right now is to move forward with measures that will make their workplaces safer and protect them — their workforces from COVID-19,” Psaki replied. “That was our message after the first day issued by the Fifth Circuit. That remains our message and nothing has changed.”
Psaki then noted that polling shows that 60 percent of businesses are “moving forward” with “components or versions of these vaccine requirements.”
So, Biden clearly doesn’t care about what the courts say or what OSHA is doing because he thinks he’s in the right. Barack Obama refused to let Congress get in the way of his agenda, and Joe Biden is refusing to let the Constitution get in the way of his.
The White House has officially gone rogue.

Vaccine Mandate Ping. Apparently da Fuhrer is again advising businesses to break the law. This should be grounds for impeachment.
No. No one is forcing these businesses to do this. He’s using the bullypupit to encourage it, but these wokester corporations always were going to do this anyway.
People don’t understand that just because the OSHA mandate gets stopped, doesn’t mean that mandates are suddenly illegal.
State Law, Title VII and the ADA provide regulations that businesses have to abide by. However, if wokester Corp A decides to impose a private mandate, OSHA has nothing to do with it.
Who’s surprised? This is exactly what dictators do!

OSHA has put the same rule out, in two routes or forms. Killing the first route does not kill the second.
OSHA Emergency Temporary Standard (ETS). These live only six months if not challenged, this one has been challenged and is enjoined by the courts. Attributes of ETS are no public notice, and the harm must be a grave danger. Another attribute is that opposition using court system starts in the Circuit Courts of Appeal.
OSHA Final Standard. These are subject to public comment and hearing before being implemented. The public comment period for the OSHA/Covid Final Standard is January 4. This form of the OSHA regulation isn’t effective yet, so there is no basis to sue - courts won’t even look at it yet. When the rule becomes effective, the lawsuits will be filed in trial court, the federal District Courts.
No basis for impeachment. The second route is still alive and well, and companies ought to plan as though the encroachment is legitimate, because nobody in the courts or government are going to say otherwise for at least another half a year.

The POTUS can cajole all he chooses. He just cannot ENFORCE.
Companies that elect to do this now would be operating extrajudicially and be exposed to damage claims by practically everyone.
This means that if someone is injured or dies from the vaccine or booster required by the company, the company is liable. Their legal eagles have probably told them that already and they are simply hoping that it does not happen.

Yeah but the red devil didn’t say to go ahead with the mandate anyway. Her intention is clear, but her words do not strictly say “implement the mandate”. This way she can escape criticism for urging businesses to implement the illegal mandate.
These companies could turn around and say they’re firing unvaccinated employees to protect those employees from the vaccinated ones who can infect them. Data would appear to back them up.
Note to employers, unlike the big pharma companies you have no liability protection if you implement this. Its all on you and your investors.
You are on the hook for any and all side effects that the vac may cause to your employees forced to take it.
Additionally you are exposed to wrongful termination suits if you terminate an employee since you did this on your own without any legal justification.
Doubtful. They are not telling people to ignore the court orders to date, they are encouraging people to get vaccinated and businesses to make vaccinations mandatory. Heavy handed - yes. But doubtful if grounds for impeachment.
Can we please just stop with the Brandon stuff and just say what we really want to?
