That “misdemeanor” would have justified their whole case that he was there illegally possessing a firearm. Or it would have never happened, therefore no justification for “Lawful” self defense or against any of the other charges...
This was a huge technicality they argued about heavily. Which luckily was dropped, or it would have nulled his whole claim and defense of “lawful self defense”.
You should read more Andrew Branca on self-defense law.
So should have the defense lawyers. The prosecution has repeatedly misstated self defense law over and over and the defense never shouted him down.
Kyle should hire Branca for his appeal or retrial because his current lawyers failed him.
