Judge shouldn’t have let it in—it was already suspect b/c the prosecution hadn’t given it to the defense
Excluding evidence is a pretty extraordinary remedy. To do so paints a bulls eye for appeal. The safe path is to admit it with limitations and let the jury decide, which is what will happen 99% of the time.
