Joe Biden’s OSHA-enforced vaccine mandate currently hangs in the balance. Last week, the 5th Circuit Court of Appeals refused to lift a stay on the “emergency” regulation, citing grave constitutional concerns and gamesmanship by the administration. Yet, there was still some hope inside the White House that the case would end up before a more favorable court to be fully adjudicated.
Those hopes were dashed to pieces yesterday evening after the court was chosen at random. The conservative 6th Circuit Court of Appeals was selected and will now hear the case.

As terrible draws go, this isn’t the absolute worst outcome for Biden. The case could have ended up back in front of the 5th Circuit, where it not only would have gotten struck down, but the ruling would have likely been broad as well. With the 6th Circuit, it’s still getting struck down, in my opinion, but it’s possible the court might not take the entire administrative state down in the process. That’s obviously a shame given how overly broad (and likely unconstitutional) the powers of the bureaucracy have become.
How the administration plays this going forward will be very interesting. Biden’s handlers had to know that they were unlikely to prevail over the issuance of an overly broad “emergency rule” that was slated to go into effect four months after its announcement. Constitutional and timing issues heavily undermine their case. But how hard do they want to push this?

The 6th is more conservative than the 5th Circuit. They will uphold the stay, and this will go to the Supremes.
The article makes a very good point that I’ve been thinking about for the last week or so. There is a good chance the Biden Administration does not appeal a loss to the Supreme Court simply because a Supreme Court decision creates a precedent for the whole country that might be much worse (for the left) than what a Circuit Court would do.

If the court tell Xiden, “Hell No! with your Mandate!”, he and his elite mediot buddies can blame the evil court for killing innocent Mericans by not forcing them to be vaccinated.
It will be his way out of the mess that he and his elite backers created by trying to push mandated vaccination on to millions of Americans, who refused.
This is only for private employers, right? The federal contractor mandate isn’t being litigated, is it? Or is this all of them?
A bit of good newsier a change. Maybe some courts are still at least slightly on the side of the people.

Do you think OSHA’s announcement today that they will stay implementation of the jab has anything to do with not wanting to aggravate the 6th Circuit? OSHA is chilling until they see which three judges are appointed to hear the cases, then they will jump back in. Their press release was significant because the usual MO for the XBiden departments is to hem and haw and tell the judge they will get to following the court’s orders after they have time to research the order. Dictate ... stall ... bring another outrage into the news cycle ... Brandon’s puppeteers at work.
My understanding is that since all the cases in the country have been consolidated into this circuit, the ruling will apply nationwide.
Biden doesn’t have sense enough to know terrible news. He is focused on his plan for the total societal collapse of the country.
They will ignore the ruling as they are corrupt criminals.
The dumbest executive ever should never have put himself and our nation in such a situation. Another dozen or so still to be tossed in the rubbish bin.

Does anyone really think OSHA thought this was core to their mission and purpose? In reality it was ruining OSHA.
This may be a setup for a pro-mandate ruling from the 6th Circuit.
