OK - but what I recall from years past, is that all FBI cases need to be approved or authorized by the DOJ. For instance, someone calls in a complaint of bank burglary. The FBI gets the facts of the case then goes to the USA for authorization to pursue the case. I’m pretty sure from my days in state LE, 30+ years ago, that is the way it worked.
I’m not sure of how DOJ/FBI coordinate, and totally believe what you say when things get to the level of bringing a criminal charge.
But my point was on the court role. Yes there is a court order, but the court didn’t just up and decide to issue one. Somebody asked for one.
