Unbelievable garbage like this is being posted on FR these days. If that is true, which it isn't, please explain why the Constitution addresses what the government can't do to an individual in the 1st, 2nd, 3rd, 4th, 5th, 6th, 7th, and 8th amendments? Sure, courts have ruled against individual liberty (Conestega and other cases ruling that police have no duty to protect any particular individual), but in this country, YES, it IS about individual liberty.

Absolutely no reason OSHA could not have started this via the normal process back in February, with full notice and comment, etc..
So I think it is at least possible that you'd get justices who might be willing to uphold the substance of the order, but not the emergency nature of it, and send it back down to go through that process.
