President Joe Biden took another hit as an appeals court has reaffirmed its stay on his vaccine mandate in the workplace.
The Fifth Circuit Court of Appeals ordered the U.S. Labor Department’s Occupational Safety and Health Administration (OSHA) to “take no steps to implement or enforce the Mandate until further court order,” Fox News reported.
This is the most recent development in what is likely to be a long, legal fight to determine the Constitutionality of the workplace mandate.
Texas Attorney General Ken Paxton, one of the critics of the mandate, celebrated the court victory on Twitter.

Step 2: Act like a Dem and assume the ruling is binding nationwide, not just in the jurisdiction of the ruling court. That’s what they always do, find some crunchy law-school reject in BFE that will say what they want, then act like it’s game over.
What Hospitals are facing though is enforcement of mandates via HHS and CMS rules who state hospitals and medical facilities that receive medicare and medicaid funds must mandate that all medical workers be vaxxed or lose their medicare and medicaid funding. Even if the OSHA rules are struck down, Hosptals are affected by different agencies that would have to also be sued! So there is no help for the skeptical unvaxxed hospital workers.

He has no choice. He has no way to enforce penalties in court against violators if there’s a stay on the order.
The normal course of action under Democrat presidents, when confronted with court decisions like this one, is to ignore them and continue with their course of action.

That case was regarding a State (Maine) action. This current case involves FEDERAL action. Significant differences are involved.
Business wants nothing at all to do with this. If the Courts give them an exit ramp they will gladly take it rather then have to waste money and time trying to impose this.
It would be a completely suidical move to try and ignore it.

You would then see the specter of open violence and US State Governments, who have vastly more law enforcement agents to call on, arrest those Feds trying to illegally impose this mandate.
No what they will try to do is get this in one of their tame Leftist courts who will do what the regime wants. That the next battle in this on going war

This will be decided in the courts. It has to be. If a company demands a citizen get an experimental medical procedure (the clot shot) then the citizen develops any kind of adverse reaction at all; it opens that company up to liabilities that may bankrupt it. We already know a certain percentage will have a serious reaction up to and including death. The risks are known so in essence these companies mandating the shot or lose their job are liable for any damages.
The adverse reaction may happen immediately or 5 years down the road but the company will still be liable if it can be proven the clot shot caused it. Chances are good to excellent there will be a lot of the same reaction to this garbage shot. Sadly a lot of companies would simply fold and reopen under a different name and structure to avoid those liabilities.
There are known cures to the WuFlu. These clot shots are not necessary. We, as a species, need to develop immunity to this virus and the next and the next and so on.
