Yes, well, spell check screwed me.

But the point stands. A mistrial is a decision that is reviewed de novo by a court of appeals, which makes it easier to overturn. You cannot overturn a jury verdict of not guilty because that would violate double jeopardy. So, a not guilty verdict is always preferable to a mistrial -- even one granted with prejudice.
