Maine Court Upholds Vaccine Mandate for Healthcare Workers

In its decision, the First Circuit emphasized the validity of Maine's purpose in issuing the mandate and emphasized a state statute that sets this matter apart from similar challenges throughout the country.

In May 2019, the Maine legislature enacted a statute that disallowed religious or philosophical exemptions from all vaccine mandates.

The workplace toxicity following this is going to be epic. What about millions of employees who have been pressured against their will by personnel because of the “coming OHSA rule,” thus separated from their body autonomy, will they be entitled to compensation at $450k per person?

The Maine court has no authority to nullify the federal Civil Rights Act of 1964.

What else you got? Or you just looking for a fight?

That’s what went through my mind;

What about all the people that were fired because they didn’t get the shots?

What about the people that did get the shots under duress, and had bad reactions and can’t work?

What about the families of people that did get the shots under duress, and died from it?

It will go to SCOTUS, but we may not like the result. I wish I did not have to write that, but I have lost a lot of faith in the “Roberts court” even when the issue appears very clear and obvious.

These stays and decisions at the circuit level should propel this immediately to SCOTUS. I have read the arguments on both sides that appear highly focused on legal nuance and past precedent.

However, I am most disappointed that the court(s) will not entertain the most obvious issue.... the vaccines we are mandating DO NOT provide lasting protection against the current variant(s). I used to believe they did, but show me the science that supports any efficacy.

They say it over and over yet all of us know vaccinated people who have gotten sick and/or even died. I think many of us know people who had adverse reactions to the vaccine.

Based on statistics it is obvious that the media maligned therapeutics have a much better benefit with extremely low risk of any adverse reaction. I would like to see that presented to court. If I have a less than 1% chance of death or serious injury from the virus AND there are treatments that have a better than 50% chance of success where is the scientific justification for me to get a vaccine that DOES NOT stop me from spreading the virus to other persons (their justification - not mine)?

That should be the argument because the vaccines have not succeeded in their stated purpose given that we will now need a continual flow of boosters for new variants or as “immunity” wanes. I would rather rely on the horse dewormer, quercetin, and my supplements and know that I would qualify for monoclonals if needed over a shot that is ineffective and potentially risky.

That is my .02. This whole thing has become a theater of the absurd mixed with politics and corruption.

OHSA trying to wiggle out of any liability by claiming it is “a work place standard” not a mandate.Actually, it’s cruel and unusual punishment without due process for not getting the vaccine, as the discussions about punitive measures for the military make clear.

The uncontested “vax only” argument has had its day, Biden foolishly decided to jump on it and try to extend it just by harnessing the hatred of the vaxxers against the unvaxxed. Bill Maher getting Chris Coons to agree that natural immunity likely as good or better shows the direction it goes from here. Not even the cowards that Trump put on the court are going to want to be embarrassed by the backlash that is so obviously coming.

The problem will be what will happen next when 2022 desperation sets in.

As we all pretty much know, liberals tend to be smug, self-important know-it-alls. I don't think they'll want to be associated with this embarrassing, obviously-inept "Administration" much longer. They won't hop on the "Trump Train," of course, but they'll likely be thinking good and hard about whether they want to be identified with the present crop of Democrats.

It'll be interesting.

If this ruling holds on up the line that means the companies that have implemented it are wide open to major civil rights lawsuits. They will be bled like stuck pigs!

I suspect the USSC will decline to stay the 5th circuit appeals court injunction. That makes the injunction permanent unless the 5th rescinds it itself after hearings on the merits, (undoubtful), and there is a good possibility that the 5th will make it a nationwide injunction after the hearings.

If the DOJ/Brandon loses at the USSC on an appeal or writ of cert then the rule will be forever stayed opening the road for cases against states and corps following the rule.
