Gov McMaster calls federal vaccine mandate illegal overreach

COLUMBIA, S.C. (AP) — South Carolina Gov. Henry McMaster said Thursday he plans to issue an executive order keeping his cabinet agencies from enforcing a federal mandate requiring companies with more than 100 employees to either have their workers vaccinated or tested for COVID-19 weekly.

Under the new order, all state agencies will be required to report to the governor if the federal government asks whether their employees are vaccinated, the Republican governor said at a Thursday news conference.

“We have been stunned at the overreach of the Biden administration. Stunned is the word,” McMaster said.

South Carolina joined a lawsuit by Georgia and seven other states fighting against the requirements that federal contractors mandate vaccines for its workers.

“People have reasons to take the vaccine and reasons not to,” said McMaster, who is vaccinated and has encouraged other people to at least talk to medical professionals and others and make an informed decision.

The governor said the state is exploring other legal options.

“We will fight every one of them with every legal tool we have,” McMaster said.

The traditional trial periods for vaccines have been skipped so what on earth would be the basis for a medical professional to say anything about how safe and effective this crap is. All it would be is a hunch or a guess.

It isn’t just an overreach of federal authority in general, or OSHA authority in particular, it is ALSO a direct violation of the Emergency Use Authorization statute itself. Under the EUA, which clearly authorizes the use of very undertested medications in emergency situations, no person can be forced to take any medication that has been FDA-approved under an EUA. That means that neither the government (on any level) nor any company can force anyone to take the medication (or, impliedly, punish someone in some fashion for refusing).

21 U.S. Code § 360bbb–3, subsection (e)(1)(A)(ii)(III)

“(ii)Appropriate conditions designed to ensure that individuals to whom the product is administered are informed—
(I)that the Secretary has authorized the emergency use of the product;
(II)of the significant known and potential benefits and risks of such use, and of the extent to which such benefits and risks are unknown; and
(III)of the option to accept or refuse administration of the product, of the consequences, if any, of refusing administration of the product, and of the alternatives to the product that are available and of their benefits and risks.”

Why this fact has not been shouted from 100 different mountaintops across the country, I have no clue - but it is a fact and MUST be brought up in every comment to OSHA during the comment period for the regulation, and in every single court case brought against this and other mandates.

Meanwhile in North Carolina the Republican legislature tried to pass a law limiting a governor’s emergency decrees to 45. After 45 days a state of emergency would have to be approved by the legislature, i.e. the people’s representatives.

Governor Roy Cooper, a Democrat, vetoed the bill.

So much for Democrats being concerned about “our democracy”. Once again the Democrat governor came down on the side of tyranny.
