Gov. Kristi Noem, South Dakota join multi-state lawsuit against Biden administration COVID-19 vaccine mandate

South Dakota has joined a multi-state fight against President Biden's COVID-19 vaccine mandate for federal contractors, according to a press release sent out Friday by Governor Kristi Noem.

“South Dakota is standing up with other states to protect our people from the Biden administration’s illegal mandates,” Gov. Noem said in a statement. “Though they are delaying their announcement of other mandates because they know those would be unconstitutional, we will not wait to fight this federal contractor mandate. We set up our defense with an executive order earlier this week. Now it’s time to go on offense.”

Biden announced in September that federal contractors must be vaccinated for COVID-19, according to the Associated Press.

South Dakota joins Missouri, Nebraska, Alaska, Arkansas, Iowa, Montana, New Hampshire, North Dakota and Wyoming in the lawsuit. There are also multiple other lawsuits against the COVID-19 federal contractor vaccine mandates.

The plaintiffs allege that the mandate is "unconstitutional, unlawful, and unwise," according to the court document.

Noem signed an executive order earlier this week protecting South Dakota state employees from the Biden administration's mandate for federal contractors. Her order also guaranteed medical and religious exemptions for the employees. Noem also announced that she would write legislation to extend similar protections for private workers.

States can’t sue the us government. They do not have standing. SCOTUS 2020

And State certainly can’t sue a frivolous allegation that an order is unconstitutional. There is defacto no law/constitution in effect. Covid! they just won’t say it. State of emergency. nullifies all courts.

Renewal of Determination That A Public Health Emergency Exists
As a result of the continued consequences of the Coronavirus Disease 2019 (COVID-19) pandemic, on this date and after consultation with public health officials as necessary, I, Xavier Becerra, Secretary of Health and Human Services, pursuant to the authority vested in me under section 319 of the Public Health Service Act, do hereby renew, effective October 18, 2021, the January 31, 2020, determination by former Secretary Alex M. Azar II, that he previously renewed on April 21, 2020, July 23, 2020, October 2, 2020, and January 7, 2021, and that I renewed on April 15, 2021 and July 19, 2021, that a public health emergency exists and has existed since January 27, 2020, nationwide.

Section 319 authorizes the secretary to determine that a public health emergency exists. This determination triggers emergency powers that permit the federal government to engage in activities such as assisting state and local governments, suspending or modifying certain legal requirements, and expending available funds to address the public health emergency.

Only the states can overthrow this dictatorship. God help us and God bless what used to be a united several states of America.

Nothing like being in front of the pack. Surprised she didn’t wait until the lawsuits were decided...before joining them.
