Jonathan Moseley, defense attorney for Philadelphia Proud Boys chapter president Zach Rehl, expressed determination to confront the FBI with a subpoena in response to National File’s report that a second man – Sean Michael McHugh – was caught on camera trying to incite demonstrators to storm the Capitol Building.
That report followed a comprehensive article by Revolver News breaking down considerable evidence that Ray Epps was acting as an FBI informant when he repeatedly urged Pro-Trump rally-goers to enter the Capitol.
Neither McHugh nor Epps have been charged with conspiracy. Moseley’s client Zach Rehl, however, is set to stand trial on conspiracy charges, despite the fact that federal prosecutors do not allege that Rehl stormed the Capitol, committed violence or destroyed property.
Moseley explained that the federal government also has not provided any evidence that Rehl ever encouraged others to behave violently on January 6. The government’s case against Rehl even acknowledges that he was only ever “armed” with a walkie-talkie.

Subpoena them.
Get them on the stand.
Put them under oath.
Make them lie about it.
Get proof they lied.
Break this thing open.
It stinks.
We have known from day one this all stinks. It may come to nothing.
But reasonable people on a jury who might not know much about 1/6/2021 beyond what CNN told them are sure to wonder why this guy who was agitating people all over the place and ended up at the breach 20 seconds before it happened did NOT get arrested, and the defendant who didn’t do ANYTHING of note...did.
Nothing may come of it. But I am sick of people just saying “Oh, nothing will happen. It isn’t worth it.”

This kind of discovery and cross examination is exactly why there have been ZERO courtroom trials in any of these hundreds of cases. Just pleadings to jaywalk charges.

I think you are right. I think they have been pursuing these in such a way to get people to be forced to plead, holding them for such long periods of time.
Furthermore, they have been pursuing charges in a way that gags certain people and puts them in a corner so there cannot be any crosstalk with OTHER defendants or attorneys.
This stinks. It makes me angrier and angrier with each passing day. I never, ever in a million years, thought I would see this kind of thing going on in the United States of America, political prisoners, being held for going on a year now (some of them) on charges that are the equivalent of trespassing or disturbing the peace.
While people who were real criminals, assaulting LEO personnel, lighting federal buildings on fire, if they are EVER arrested are simply let go. Hell, look at the Leftist criminal scumbags who did far, FAR worse at the Department of The Interior a few weeks ago, but...who heard of it? Who has been charged, not just arrested and let go? Maybe ONE person that I have heard of?
I am ashamed of it, as an American, and it is making me hopping mad.

Sickening that a former US Marine sits in jail, misses his daughters birth....didn’t even enter the Capital building....we need justice.

How would a businessman in Arizona become a FBI informant in Washington, DC? It just doesn’t make sense.
You are right. The government is violating the Constitution on all these people. The 4th, 5th, 6th and 8th Amendments have been routinely violated with these being held; and it is ongoing. Like you, I never imagined such a thing.
4th: unreasonable searches and seizures. These peoples’ houses were broken into and pilfered looking for evidence w/o probable cause nor reasonable suspicion.
5th: to my knowledge grand juries were not as involved in these cases as the Constitution demands; they are imprisoned w/o fair trial in total violation of this amendment; these extracted pleas are self-incrimination, period.
6th: this is the worst violation of all, IMHO. There should’ve been speedy and public trial, trial by an impartial jury, and to be informed of criminal charges. Witnesses must face the accused, and the accused is allowed his or her own witnesses. None of these provisions are being granted.
8th: excessive bail and fines and cruel and unusual punishment. These people have been held w/o bail (surely that is excessive), and the solitary confinement and mistreatment we’ve heard about DEFINE cruel and unusual (esp. given the miniscule charges).
We need our country back; and when we get it, huge swaths of the bureaucracy must be dissolved. I’m dreaming, I know.
