No I'm not......It has absolutely no bearing on the issue currently being discussed.......

No employer can deny any employee the retirement benefits they qualify for regardless of the reasons for termination..........

Ex-copTed Williams was on Fox lambasting the police that wouldn’t submit to Beetlejuice’s jab mandate. I have completely lost respect for him.

Taking away retirements? They’re evil, just evil.

If they do that, they will have forced these police into desperate measures — that’s destroying a man’s livelihood to the point of destitution.

Many of them will likely resort to desperate measures, to include violence. And they are well trained for that.

CHICAGO (AP) — Chicago’s police chief has put into writing a threat that officers could be fired if they don’t comply with the city’s COVID-19 vaccination policy, adding that those who choose to retire rather than adhere to the policy might be putting their retirement benefits at risk.

In a memo sent Sunday night, Chicago Police Superintendent David Brown said that those officers who do choose to retire rather than comply “may be denied retirement credentials,” the Chicago Tribune reported.

On Sunday, Chicago Police brass issued a memo that threatens those who do not comply with Lightfoot’s COVID-19 vaccination policy with a disciplinary investigation that could result in the termination of officers who refuse to get the vaccine — but the police union, in its own memo to officers, maintains the order is “invalid.”

The police memo, sent Sunday night by a member of Superintendent David Brown’s office staff, also threatens officers who might choose to retire rather than get the vaccine. It says: “sworn members who retire while under disciplinary investigations may be denied retirement credentials.”

The FOP, in response, sent a document to its members that provides language officers can use should they be asked to go to Internal Affairs and given a direct order to report their vaccination status through the city portal, according to multiple law enforcement sources.

Would ERISA apply since it’s a governmental entity?

I'm not so sure now. From what I've been able to find on the internet, the pension laws under ERISA only apply to private sector employees.......

So I may have been mistaken in my prior comments......

What I saw said ‘in general’ it doesn’t cover governmental entities. That makes me think that some parts might apply to the governmental entities. Somebody better than me will have to figure it out!

Good question. I guess a case could be made denying the pension, but how do they prove I didn't apply to retire because my bunions hurt?
