The public “trials” are being “postponed” until they can better impact the midterm elections.
Prosecutors know that a speedy trial, normally in complex cases, works against the defendant because it does not give them enough time to interview witnesses favorable to the defense or to investigate the prosecutions witnesses for lies or or issues that would reflect on their credibility.
The other side of the speedy trial issue is that if the defense refuses to waive the right to a speedy trial,(ROST), in cases where the prosecution hasn’t done a thorough investigation before filing charges it forces the prosecution to go to trial unprepared.
For the defendants jailed in early January there would not have been enough time for the prosecution to have put together a solid case if they had not gotten the defense to waive ROST.
