Supporters have raised over $2 million for the marine who was jailed for defying orders to stop publicly criticizing America's chaotic withdrawal from Afghanistan.
Lt. Col. Stuart Scheller, 40, was arrested and jailed at the Camp Lejeune brig on Monday for breaking four military laws by refusing orders to stop posting videos that were critical of the military on social media.
The Marine, who has served 17 years in the military, is scheduled to make his first court appearance in North Carolina next week, DailyMail.com has learned.

Glad to hear he has a lot of supporters. I don’t know much about the military code of conduct but it’s a shame that he - or anyone - is denied their basic Constitutional right to due process. Weeks locked up and hasn’t had his first hearing?

I thought he resigned... The point of being a Commissioned Officer it that your loyalty is to the Constitution and the American people, and not to any rules or regulations. If you don’t want to follow an order you can resign at any time as a Commissioned Officer. Mattis even talked about an Officer in combat that came in and resigned his commission during the assault on Fallujah...
Yet for some reason they are not letting him resign... This doesn’t make any sense. Eisenhower resigned and ran for President.
The point of having a commission and not an enlistment is that you are bound to follow orders unless you resign... he resigned so what is the issue? Am I wrong here? The reasons are obvious. For enlisted members if they receive an order from a commissioned officer and they follow it they are given the benefit of the doubt even if that order turns out to be illegal. Why because in combat you need people to do what they are told immediately in order to win. If the order given is illegal then it is on the man that issued the order unless it was CLEARLY an illegal order like...”kill that kid he is looking at me funny.” or “shoot that guy he likes Trump”
For an Officer there is no provision. A Commissioned Officer is expected to be able to recognize an illegal order (Such as go in to that house and kill those people because they have been branded as traitors to the state and we are trying to establish a communist state here in the US). The power given to the Commissioned Officer is their ability to resign in the face of an illegal order or anything else for that matter. An Officer is supposed to say something like what you are telling me to do is bad and I am not doing it. Also, they are able to resign in protest which is what this man did. Yet now he is in the brig? Doesn’t make any sense.

The Military is anything but constitutional, democratic or fair in the way it operates nor is it supposed to be. The only way the military can function is by the soldiers strict adherence to the rules and regulations regarding the chain of command and any orders issued by superior officers.
I am happy this man has the support he has and I wish him well but what he did was in direct violation of the regulations.

I think he made his comments before he asked to be relieved.
Yes, he was relieved for cause... which is fine. But then he tendered his resignation and they refused to accept it and now are muzzling him by refusing his resignation. That can only be done if he broke a rule prior to his resignation. I listened to his statement... he didn’t express contempt for any protected official.
Didn’t he speak out in a way critical of his superior officers with regards to how the evacuation from Afghanistan was handled?
That is a pretty big no no. While a superior officer can be criticized there are regulations covering that procedure and they involve climbing the chain of command step by step and getting permission from each level to proceed. An audience with the commander you are questioning can be requested and if he agrees you can speak your piece if it is permitted.
That’s how it was in the military I was in during the 60’s although it may have changed.
I listened to his original statement also.
Based on personal observational experience he appeared to be in the middle of a manic bi-polar episode.
The USMC may be protecting him and his family by refusing his resignation and trying to provide medical attention.
Then again, this has been a strange decade for our country.
....you seem to be drawing a distinction between enlisted and officers when it comes to their day one oath. My oath as an enlisted man included the words obliging me to obey “ALL LAWFUL ORDERS”.
So, I’m sure there ARE some distinctions between officers and enlisted but “obeying lawful orders” is a burden on every person in the U.S. military.
He probably should have resigned rather than “buck” the system. He created a contract with the military and is required to follow the regulations and directives of the business. And as long as he is within the system, that money they solicited is worthless.

He violated article 92 of the UCMJ, for failure to obey a direct order. He doesn’t deny that and unfortunately this is within both the UCMJ and the SCOTUS as listed above.

I understand what you are saying, but, even in the military justice system there must be some regulations and procedure to follow. I honestly don’t know but can a service member be locked up without a hearing for weeks? Apparently the answer is yes, but is that procedure actually by the book?
Again, I don’t know much about the code of conduct but my impression was he broke it, he knew he was breaking it, and did it anyway. So of course he knew he was facing disciplinary action. I think in one of the videos he even acknowledged that he would.
His actions were wrong. His opinion as I heard it was 100% right.
I will not argue the right or wrong of what the Lt. Col. Did. What I BELIEVE is that in direct opposition to Mark Milley, Lt. Col. Schuller is a man of honor and integrity.
