In the military, you do not have rights.
He was ordered to shut up. He did not.
He started posting in uniform on political matters. That is a Big Deal and against military law.
Then he went around the chain of command. Which is also illegal.
He knew this, and chose to be arrested. He will at best get an other than honorable discharge, and at worst serve some prison time.
Heck, in high stakes industry that is the same.
When you are in the middle of an upset event that can lead to sending a chemical cloud over a metropolitan area, you do not have time to argue philosophy or disregard the chain of command.
Same with speaking out publicly while in a leadership position. In every company I have EVER worked in, doing that will get you fired and probably sued into oblivion. That includes “whistle blowing”.
Have I been in a position where I felt my and my crews life was in danger because of foolishness? Yes. I made a decision, did not follow the directive, and submitted my resignation that day. I was right, saved people from harm, but still had to pay the consequence. In that case they did not let me resign, but I did get a write up.
And that was NOT in a place where people are going to shoot at you. The military is a level above (I think) accidently releasing an acid cloud downtown on a Saturday night.

At the same time, though, do you not agree that it is selective and political in that so many others are not incarcerated for the same thing?

I know that not finishing something that you started is surrender. In a perfect world, you'd be swallowing a few teeth.
