While Mike Pence was lauded by Democrats — and widely criticized by the president and the Republican base — for his refusal to overturn the results of the election won by Joe Biden in 2020, it turns out that a different vice president may have been responsible for the decision.
In the upcoming book Peril, Robert Costa and Bob Woodward write that then-Vice President Pence reached out to 74-year-old Dan Quayle — who served as vice president from 1989 to 1993 under President George H. W. Bush — in the waning days of the Trump presidency.
"Over and over, Pence asked if there was anything he could do," Costa and Woodward write, suggesting that Pence was looking for a way to acquiesce to Donald Trump's demands that he reject the electoral votes legally-cast in Biden's favor.
According to the book, Quayle quickly put the kibosh on any effort to overturn the election, telling Pence: "Mike, you have no flexibility on this. None. Zero. Forget it. Put it away."
When Pence "pressed again," the authors write, he did so by explaining that he was under pressure from Trump. (A spokesman for Pence did not respond to a request for comment on Peril.)
"You don't know the position I'm in," he told Quayle, according to the authors, to which Quayle responded: "I do know the position you're in. I also know what the law is. You listen to the parliamentarian [who issues rulings about congressional authority]. That's all you do. You have no power.'"

But only in the event that no candidate received an absolute majority of the electoral votes. That was not the case. Biden received 306, well above 270 required.

RINO’s and the 4C Country Club/Chamber of Commerce Republicans are going to do what they do best: apologize to their good friends across the aisle and let them make the rules as they go, recognize they are being cheated and agree to abide by the rules and law when the Democrats enforce a rule on them that costs them an election, lose time and again and be good sports about it and then chastise those conservatives who dare to not bend over and grab their ankles.

Pence could have said to Quayle, “go pound sand, I should back my President and question the states whose ballots are too questionable to pass them as legitimate!”

What Pence said as he called out states differed from what vice presidents have said in previous sessions, Politico noted.
Under the Electoral College system, voters are actually choosing electors when they vote for a presidential candidate. The party electors then, in almost all cases, cast a ballot the following month for the party’s candidate. The winner of the popular vote in a state is certified as the winner, and that certificate is counted in the congressional joint session.
Republican electors in those states last month cast a ballot for Trump, planning to send it to Washington. Democratic electors cast a ballot for Biden. The situation is known as dueling electors.
In past joint sessions, vice presidents have read so-called alternative electors. For instance, Vice President Richard Nixon in 1961 was initially declared the winner of Hawaii, but candidate John F. Kennedy was later certified as the state’s winner, just two days before the joint session that year. Congress received certificates from Republican electors, Democratic electors, and a package from the archivist of the United States.
How about questioning the legitimacy of a given state’s election and certification?

Only a slate of Electors accompanied by a Certificate of Ascertainment, signed by the States Governor, and sent to the National Archive is valid.
Alternate slates did not have these, did not follow protocol, and were not recognized per the Constitution.

"According to the Congressional Research Service, when dueling slates are received, members of Congress in the joint session consider the list when its from a different state authority than the certified list, and conduct a vote. Acceptance of either slate would then require a concurrent agreement in both the House and the Senate.
Yes, and the alternate slate of electors both included the required certificates of ascertainment. This is because the election was so close that audits were still being performed. Once that was complete, the Governor basically cancelled one slate.
This has nothing to do with 2020.
The only thing Pence should have done is walk away from the process and let the next in line in the senate do the dirty deed. Instead he happily joined the whole circus and attended the inauguration as if everything was hunky dory. None of this may have changed the result but by what Pence did he joined the enablers. It was bad optics and it will likely prove fatal to his political future.
