As I understand it OSHA will have to have some amended regulations which will require a period of public input.
The states can file detailed statements which can later be turned into court filings stating their views.
This is going to be a lengthy battle, not a short one.

Under normal circumstances that’s correct. However, OSHA can use an “Emergency Temporary Standard (ETS)”. That eliminates the otherwise required public comment period. I believe it has been announced that they will use an ETS to fulfill president idiots executive order.
