It's a tax was the cleverest little bit of fraud perpetrated on the US Constitution in a long long time.

Obama didn't want to call it a tax because several members of Congress wouldn't have passed it as a tax. It was called a penalty, and the Democrats even refused to defend it as a tax at SCOTUS.

Calling it a tax would have strengthened the opposition to it under the origination clause, since revenue bills must originate in the House and the Senate took an unrelated House bill and gutted its original content via amendment and inserted Obamacare in its place.

Technically, the bill originated in the House but it was not a revenue bill even in the House. Calling it a tax would have meant the Democrats could be accused of using loopholes and trickery to pass Obamacare, so they called it a penalty.

The case against Obamacare's lack of origination in the House was eventually dismissed by SCOTUS.
