I hold that the federal ban even when passed by Congress is unconstitutional. It is an unlawful taking of property. The decision only addresses the CDC ban but should be expanded to keep congress from doing it either.

How does he get there? Simple: the part of the law that grants the surgeon general the power to enact “other measures, as in his judgment might be necessary.”
So, the Surgeon General can keep Justice Breyer in solitary confinement if he so judges Justice Breyer’s level of stupidity to be a communicable mental health issue?
