Landlord Group Sues Biden's CDC Over Eviction Ban Extension

Landlord groups are suing the Biden administration for extending the pandemic eviction moratorium from the Centers for Disease Control and Prevention, claiming the new order can only be extended by new legislation, as ruled by the U.S. Supreme Court.

The Alabama and Georgia associations of Realtors filed an emergency motion Wednesday night with Judge Dabney Friedrich of the U.S. District Court for the District of Columbia, asking her to enforce the Supreme Court's recent order stating that the CDC could not extend the moratorium without new legislation.

The Alabama Association of Realtors said the CDC issued the new order "for nakedly political reasons – to ease the political pressure, shift the blame to the courts for ending the moratorium, and use litigation delays to achieve a policy objective."

About half of all housing providers are mom-and-pop operators, and without rental income, they cannot pay their own bills or maintain their properties

They’ll win. Biden knows it, too. He’s just counting on the delay taking it to SCOTUS to hurt landlords as much as he can.

Have my doubts...Dems own the media, the courts, SCOTUS. This is just another step in eliminating private property rights amongst the middle class.

The court has ruled. It is time The States defy this illegal action of Biden. Evict them. I predict this will happen in Red States.

Good, but what needs to happen is the order declared invalid retroactively and the land owners indemnified for the unjust taking of their property and services.

NO branch of government has the right to invalidate a valid contract between two parties not including itself. Not the executive, not the legislative, not judicial, and not a government agency.

I know there’s no stopping it. The dems are rushing to turn the country communist before anyone realizes it, and the republicans, with few exceptions, are a bunch of spineless, testicle-less wusses and wimps who are worth absolutely nothing and serve no discernable purpose in the universe.

The brain-dead American public, already known for its gullibility, doesn’t have a clue. Maybe they’ll realize what’s going on when they come for them, but I doubt it. After landowners it’ll be homeowners, car owners, people with IRAs or 401Ks. They are coming as sure as the sun is coming up in the morning.

I think you are right. The SCOTUS judges that allowed the last extension actually said in their decision that it was not constitutional (which makes their decision curious) and that another would not pass muster.

So they should just start evicting.

The supreme court already said the CDC can’t do this, and they did it anyway.

And now we are going to try to stop this with the courts? Serious?

All that has to happen is for one to switch sides. Justification for "switching" can be a flimsy pretext.

CDC moratorium that was struck down was blanket. This one is targeted.

I'm not of a mind that the feds have this power at all, not even via legislation let alone via CDC or some other regulatory body. Just of a mind that the courts are there to protect the government. The government is what pays their way.

As stated above, it would have to start with a state ignoring said ruling. However, that still might not work because the courts could ignore the states mandate.........
