Why would Kagan join the majority before Roberts does, especially since Roberts voted for the 2nd Amendment in Heller and McDonald?
Roberts will be in the majority. I did say at least 6-3 in favor of the 2nd Amendment. The wise Latina and Breyer are the only ones who might go against the 2nd Amendment. It might even be an 8-1 decision; possibly 9-0 if Sotomayor doesn’t want to out on a limb by herself.
