Poland’s long-running dispute with the European Union over the rule of law escalated on Friday after Małgorzata Manowska, the chief justice of the country’s Supreme Court, said the institution would refuse to comply with new orders issued by the Court of Justice of the European Union (CJEU).
Earlier this week, the CJEU ruled that Poland’s system for disciplining judges, introduced in 2017 under the conservative-nationalist Law and Justice party, contravenes EU law. It ordered the suspension of the disciplinary chamber which forms part of Poland’s Supreme Court.
CJEU found that the chamber “does not provide all the guarantees of impartiality and independence and, in particular, is not protected from the direct and indirect influence of the Polish legislature and executive.”
The court called on Poland to take immediate measures to rectify the situation, or face financial penalties.
In defiance of the verdict, Manowska announced that she allowed the chamber, which she described as “fully independent”, to continue functioning. In her decision she referred to a ruling issued by Poland’s Constitutional Tribunal on Wednesday which found the European court’s verdicts violated the Polish constitution.

Hey gutless American politicians take note, you passed the laws and the courts are supposed to enforce (only). They can opine that a law is unconstitutional, but they cannot rewrite through activist interpretation. If the court decides they are an un-elected super-legislature that trumps the laws as your wrote them, tell them to stuff it (then impeach them).
The beauty is if the other Eastern Europeans like the Hungarians and Slovaks and Czechs back them - which they will, there isn’t a damn thing the EU can do about it.
The Eastern Europeans are smart. They’ve learned the bitter lessons about how socialism does not work and they had to fight hard to regain their national sovereignty after decades of foreign oppression. They’re not about to give that up. They will however be happy to soak up EU structural funds to pay for their infrastructure, agriculture subsidies for their farmers and free movement to allow their workers to go to Western Europe to make much higher salaries and send the money back home. This is making climbing out of the hole decades of socialism put them in much easier and much less painful.
As Nigel Farage has repeatedly said "I love Europe,it's the European Union I hate" (not an exact quote).

I agree, and furthermore wouldn’t be surprised if those communist pieces of garbage are behind more hacking and election interference than the rest of the world combined.
Also,consider this....twenty plus years ago Ireland was the naughty child of the EU. But over time,thanks largely to huge sums from Brussels,Ireland is now just another tawdry little European cesspool.
If France elects LePen, a lot of the issues will disappear.
They can’t expel them unless the vote is unanimous....and the others in Eastern Europe will never allow this.

I think the best way to do that is to say “We are following our Constitution. If that’s not acceptable, you kick us out.”
Then the EU is really in a pickle.

Anyone who thinks judicial conduct conditions in the states have any real interest in disciplining corrupt judges is naive.
