Re: Texas penal codes: 22.05 Deadly Conduct & 42.01 Disorderly Conduct.
I believe the prosecution will try to prove that the one killed was "acting disorderly", which probably does not justify him being shot and killed. The defense will try to prove that the person killed was displaying "deadly conduct", which should acquit the person being charged.
