IIRC, didn’t Kennedy ‘require’ that Kavanaugh replace him, in an agreement for Kennedy’s leaving? I remember at least rumblings about that.
Next up: NY’s “special need” clause is constitutional because you will have demonstrable special need for a handgun carry permit after being fatally attacked.

I never liked Kavanaugh from the beginning. Frat boy, beer drinking party animal. Just wants to be popular. Bet he was a real jerk in college. Arrogant Jerk. We probably would have got into it somewhere along the way, in the gym or something. Him and his buddies........beer drinking obnoxious law students.
The court is incompetent and has no idea what is constitutional or not. The government does not have the right to invalidate a valid contract between two parties other than itself.
The government has forced landowners into unpaid servitude, since it requires them to provide an apartment, heat, utilities and insurance, and to pay the mortgage and maintenance.
So that means Roberts once again went with the liberals along with Kavanaugh.
The final provision in the 5th Amendment states, “nor shall private property be taken for public use, without just compensation.” Pretty clearly if CDC isn’t paying these rents, this order is a direct violation of the Constitution, Kavanaugh’s and Roberts’ opinions be damned.
We should never allow another ivy league educated judge on the supreme court. They know how to pretend to believe in the constitution then immediately turn away.
So now the CDC is the legislative and executive branch of the government. That was the quickest amendment of the Constitution we’ve ever seen!
I agree that the order is a violation of the constitution, but not because of the 5th amendment. There is no public use here. It’s a branch of the feds stepping on private contract. This is not among the powers granted to the feds, until the court branch of the feds declared that the commerce clause power can be used to justify any regulation the federal courts choose to endorse or stay mum on.
Indeed. The court once again simply declines to do it's job. It takes so long for cases to make it to the court that the they should have heard the case and made a decision on the merits regardless of when the order is set to expire. No one who is paying attention can doubt that this will be the last such order of its kind as long as the court doesn't tell the government that it has no such power to make such a sweeping taking from the American public. The supreme court has proven itself to be utterly worthless once again.
Even if they were right on the merits, how can some medical agency have final say over enforcement of contracts?? How can we possibly be putting up with this crap? And I notice they didn’t tell banks they had to suspend payments or interest on mortgages on income property.
