It's funny that you mention legal and monetary remedies, because the war-gamed document for the 2025-2028 pandemic scenario (Johns Hopkins Center for Health Security) envisions a payout fund as part of the compensation for those harmed by the vaccine.

Gene therapy involves making changes to a person’s DNA in order to effect a result.
The mRNA platform does not and cannot enter the nucleus (which is where DNA is stored, does not and cannot unravel DNA strands, split strands, perform cuts, perform inserts, or perform repairs. Rather, the mRNA platform relies on delivering mRNA to the cellular cytoplasm, which is where ribosomes are, so that said ribosomes can do the only job they do, which is to take mRNA and produce the encoded amino acids or proteins.
The “argument” for why it isn’t gene therapy is that it doesn’t fit the definition for “gene therapy” by any stretch of the imagination.

We have been lied to through the abuse of language, time and time again. Here are a few instances that come to mind:
“Covid vaccine,” actually gene therapy.
“Soviet Union,” actually Russian communist empire.
“North American Free Trade Agreement (NAFTA),” actually not a free trade agreement (NAFTA).

Moderna called its product “gene therapy” in its SEC filings. They also said that mRNA is considered a gene therapy product by the FDA.
No they didn't. They stated in their SEC filings that the FDA currently classifies it as such and that the classification could generate some negative consumer sentiment. The document you're referring to is an investor document intended to highlight both strengths and risks to the company's bottom line so investors are able to make an informed decision about holding the company's stock. Perception can be a significant risk to the company's bottom line, regardless of reality, so they're required to include information like that.
It's still not gene therapy. It still doesn't have any way to enter the nucleus. It still doesn't have any way to unravel DNA. It still doesn't have any way to perform cuts in DNA. It still doesn't have any way to perform inserts into DNA. It still doesn't have any way to perform repairs to DNA. That's not what mRNA does. This is Biology 101.
It seems to be a local/national on-line news site, sort of like Patch, but for business news.

An mRNA (look up what an messenger RNA does) instructs your DNA, which are your genes, on how to respond.
Your DNA is like your computer BIOS (basic input output system). Thus, yes it is a gene therapy.
You have failed Biology 101. This is not how this works. DNA contains nucleotide sequences for amino acids and proteins. An enzyme called RNA polymerase builds messenger RNA from DNA base pair sequences through a process called RNA Transcription. The mRNA is then transported out of the cell nucleus through nuclear pores with the help of transport proteins. The mRNA encounters a ribosome in the cellular cytoplasm and the ribosome constructs the amino acid or protein based on the mRNA strand's nucleotides through a process called Translation.
I hope you're paying attention; there's going to be a test on this soon.

You have failed Computer Science 101. The two are absolutely nothing alike whatsoever. DNA encodes instructions for the creation of amino acids and proteins. This process continues throughout the life of each and every cell. A computer BIOS contains the basic instructions to start all the underlying hardware until a hand-off to a selected bootloader can occur. At power-on, the CPU executes a jump instruction to begin executing the BIOS from ROM. The BIOS performs a POST (power-on self test) and then loads the configured bootloader partition into memory and hands off execution to the bootloader. From there, the bootloader loads the operating system, which then takes over execution and interacts directly with the hardware via drivers (sometimes using a HAL - or Hardware Abstraction Layer).
One has absolutely nothing to do with the other.
