As more people get their COVID-19 shots, many are finding themselves in a position of having to ask others about their vaccination status.
Some are wondering if this violates the Health Insurance Portability and Accountability Act, or HIPAA.
Ellen Cihak has not been asked if she is vaccinated against the coronavirus. She also hasn't been asked to show proof in Appleton stores.
"I would like to see that happen. I don't know if it's legal to do that," said Cihak.
Like many others, Cihak doesn't know if the question violates HIPAA.
John Fisher is a health care attorney who specializes in health care compliance and ethics. He says although the vaccine status questions might be uncomfortable, it does not violate HIPAA.

LOL ... I have also seen a meme going around the internet where if someone asks if you have been vaccinated, respond by asking them if they like an@l sex. When they look at you dumbfounded then say ... well, since we are asking questions that are none of each others business ...

That statement is as illogical as “my mask protects you”. So now we’re onto “my shot protects you”?

Rightly or wrongly, some people will answer that they are vaccinated when they are not. It’s just the way it is.
If someone asks “are you vaccinated?”, your response can be “have you been treated for STDs?”
“Actually HIPAA does not preclude your right to not answer. It is your basic right to not disclose anything about you. It’s privacy. HIPAA only applies to the transmission of protected data from entities requires to maintain confidentially. An individual person has no HIPPA duties.
And a person can always waive HIPPA.”
Thank you for this important clarification of rights and duties. I have waged an uphill battle on FR and elsewhere to refute the widespread belief that HIPAA precludes non-covered entities (e.g., grocery stores, restaurants) from asking about your vaccine status.
But I CAN refuse to let you eat in my restaurant if you refuse to answer.
Ask away, but I am not answering. It is no one’s business. I’ll keep my mouth shut. This is getting to the point where you have to invoke your 5th amendment rights to not incriminate yourself.

Because every doctor knows Physician-Patient Privilege. That Karen ought to be asked if it's ok said journolist call her doctor and get her treatment history. VD, manic depression, the other maladies she has besides Karen-itis that constitute a public health threat. Same goddamn thing.

if you are vaccinated why would you care about others status ?
