With Virginia having seceded, the Union Army, which was occupying Alexandria, woke up the City Council members in the middle of the night, constituted them the “State Legislature,” and told them if they wanted to get back to bed, they would need to approve the creation of West Virginia. So they did.
Demonstrating that the secession of the WVA counties ignored the Constitution. But then it’s just one of many other expedient but illegal orders during the 16th administration.
The attempt to have Chief Justice Taney arrested is one of my favorites. Along with arbitrarily stripping Clement Vallandigham of his citizenship. Arresting the entire Maryland legislature. Shutting down hundreds of newspapers.
Amusing story but nowhere close to being factual.

I don’t remember learning this in U.S. History in High School, and as far as learning U.S. History in the 1980’s in High School goes, I studied under the best.
