A federal judge Wednesday vacated a nationwide freeze on evictions that was handed down by the Centers for Disease Control and Prevention (CDC) to help some renters remain in their homes during the COVID-19 pandemic.
The moratorium had been implemented as millions of people lost work due to lockdowns caused by the pandemic. The move, which was first implemented in the March 2020 CARES Act, was seen as a temporary fix for renters who were at risk of going homeless.
U.S. District Court Judge Dabney Friedrich ruled on the side of the plaintiffs, saying that the CDC exceeded its authority with the moratorium.
“The question for the Court is a narrow one: Does the Public Health Service Act grant the CDC the legal authority to impose a nationwide eviction moratorium? It does not,” Friedrich wrote in a 20-page ruling. “The pandemic has triggered difficult policy decisions that have had enormous real-world consequences. The nationwide eviction moratorium is one such decision,” the judge added.
The Department of Justice (DOJ) said Wednesday it would appeal Friedrich’s ruling.
But Friedrich added that “it is the role of the political branches, and not the courts, to assess the merits of policy measures designed to combat the spread of disease, even during a global pandemic.”
The eviction moratorium has been heard in other courts since it was implemented. Some courts have, in fact, said the CDC has the authority to issue the order and rejected efforts to stop the ban on evictions, although a judge in Ohio in March ruled the agency overstepped its authority
The Epoch Times has contacted the CDC for comment.
Luke Wake, an attorney at Pacific Legal Foundation, a group that represents landlords, said the ruling Wednesday suggests that the CDC is losing the fight in keeping the moratorium intact.

My SIL and BIL have a rental where the people have not paid in 9 mos and are totally destroying the house but they cannot evict them. She has am emergency hearing on May 7th where the court is hopefully going to issue an eviction notice due to extreme circumstances. They are going to have to wholesale the place off as they don’t have $50,000 for repairs.
I have a tenant that has not paid for 12 months as of the first of this month. Still waiting on the state of Alabama to approve and disburse funds from the emergency rental assistance program.
And it's going to get a lot rougher.
The Government may try to take that cave owned by you in order to placate the mobs. They will be most unwilling to admit that they caused the problem in the first place.
It will take more than hard attitudes to get through this. A bunch of trust-worthy friends would be really helpful.

The left was once virtually defined by class warfare. Now, they’re stirring up racial animus — to the point of potentially igniting a race war. I think the left was terrified that Trump was making inroads with Blacks and Latinos — by demonstrating ways their lives could be improved; and, as a consequence, highlighting the abject failure of leftist ‘solutions’ to actually solve anything.
Cue up identity politics, to provide enough racial animus to prevent working-class people of all races from focusing on their common interests, and turn them against each other. They don’t want anyone to notice that poor whites have more in common with poor blacks and poor Latinos, than they do with uber-wealthy whites. To do that, every white male has been cast in the role of oppressor — no matter how much ‘oppression’ they, themselves are suffering from. Pure evil.
Because of the way they pit people against each other for pure power and political gain, I have come to despise the Left more than I thought I ever would.
