It’s not double jeopardy. We have dual sovereigns. Thus, you can be charged under State law and Federal law for the same incident.

I personally think this doctrine should be overturned, but it was just upheld by the Supreme Court in Gamble v. United States in a 7-2 decision. Only Gorsuch and Ginsburg disagreed.

Justice Gorsuch got this right for the right reasons, Ginsburg got the right result for the wrong reasons.

I can't believe this is constitutional no matter what anyone says. It most certainly is double jeopardy, and any ordinary citizen alive in Jefferson's day would immediately recognize it as such. Only a lawyer could contort law in such a way as to void the constitutional rights of innocent men.
