Sue both the department and the individual. It’s done all the time.

When was the last time a police officer was successfully sued for what they did on the job? He has qualified immunity. And since the Capitol Police are an agency of Congress then they may have sovereign immunity. That'd be for the courts to sort out.

How long have you been sleeping? Officers have been tried for overdoing use of force for at least the last 8 years.
