Ex cop friend of mine said he might have done the same thing, but with just the still picture the optics are really bad.

The initial optics look bad but indications are he had a gun which he threw behind the fence. When he lifted his hands the cop had no idea he had tossed the gun.

He likely thought he was being clever by throwing the gun away and looking unarmed when he raised his hands but the cop couldn't know what he had done.

He made the mistake of ditching the gun in a sneaky way.
