The power of the states to remove illegals has been eroding since the 19th century. But, it wasn’t until a Supreme Court case from almost a decade ago - Arizona v. United States - did the Court foreclose the state’s ability to enforce immigration laws.

The best a state can do is inquire to a person’s citizenship status during the course of an otherwise legal interaction. I believe that they can still detain a suspected illegal, but only for a finite period of time, usually the length of time it takes ICE to show up and now - under Biden - simply release the illegals again.

I guess the state could keep arresting the same illegal as soon as they walked out of the jail after being released by ICE. But, if that happened, an injunction would surely be sought and granted...making it all Kabuki theater, as I said. When Arizona lost that case, it really ended the legal debate.

I don’t understand why the AWOL parents can’t be charged with state crimes. Child endangerment, etc. If you or I abandoned our kids in the desert we would be facing long prison terms. Are they claiming asylum and immigration law trumps state law? Or are Abbott and Ducey just Chamber of commerce owned wimps?
