A living Constitution implies a living precedent. Change the headcount and it's all up for grabs. Bidet may win for 4 years but when the tide turns - and it will - then effectively repeal the New Deal interpretation of the CC since the living Constitution DEMANDS it.

OK, then, if precedent were to be eliminated, even partially, how would that constrain a packed Supreme Court? Seems to me that it would accomplish the opposite.

We need for nobody on the SCOTUS to retire or die in the next 2 years. I think we’ll retake the Senate in the 2022 election and will thus have the votes to block any of Pedo Joe’s nominations but we have to cross our fingers and hope for no attrition in the next 2 years.

That is an interesting idea, and will play to our advantage in the long game, but I think we need to fight this full frontal first.
I doubt the left is smart enough to understand the self undermining they do with stuff like this. It has happened before. I say let them hang themselves.

All you need to do, is float the intent to erase stare decisis the nanosecond there is one more jurist placed on SCOTUS. There are hundereds of conservative justices below SCOTUS who will take action. Leftists will whine but as Rehnquist wrote, "precedent" isn't carved in stone. Announce that any case based on the wrong intent of the Commerce Clause will be struck down. Get a good head of steam rolling. All you need is the mere appearance of equating packing with tearing down the legal basis of Leviathan. Poison pill. And stand strong.
