SCOTUS selections are political. So why shouldn’t their opinions be just that?


The Founders hoped that there would be no political parties in the new America. They knew what party politics had done to Great Britain. So they wrote the Constitution on the assumption that there would be no political parties. The election of 1800 showed that they were wrong.

But by then the Constitution was written with the idea that giving Judges/Justices lifetime appointments they would be immune from any political considerations. They also never foresaw the role that SCOTUS took on for itself, i.e. declaring laws unConstitutional
