It’s not. The Constitution is very clear on this. And, it’s very likely this will wind up at the Supreme Court. HOWEVER, under the John Roberts court there’s no assurance that the court will accept the case much less rule against the Dems should it be accepted.

0 chance. Robert’s always weasels out falling back on Congress as the final say

Look at Pennsylvania as the prime indicator. Unelected changed laws over elected and he’s ok with that as the state certified in spite of that blatant violation

The only thing the SC seems to do is deal with free speech cases
