There is something to be said for his point of view. There is no way to predict what a court will rule, and no question of "constitutional or not" is ever finally settled.

On church closings, capacity limitations, and so on, the courts have been all over the map the past year. Started out "church must give way to public health," nothing unconstitutional about the government ordering them closed.
