Oklahoma House Passes Bill Allowing State to Review, Reject Biden Executive Orders

The Oklahoma House of Representatives passed a bill Thursday that would allow the state to put the brakes on the power of President Joe Biden’s executive orders there.

HB 1236 would allow the state legislature to review each executive order and determine if it should be given to the Oklahoma attorney general, who would determine if it is allowed under the U.S. Constitution.

If the attorney general deemed an executive order unconstitutional, the bill seems to indicate the attorney general could sue for a court order invalidating the executive order.

If the attorney general decides not to take action on an order, the legislature could conduct a majority vote declaring it unconstitutional.

If the legislature invokes its option to declare an executive order unconstitutional, the statute is unclear whether the Oklahoma government would file suit or the state would ignore the order inside the state, leaving it to the federal government to enforce or try to take it to court.

The bill states:

Notwithstanding any other provision of law, the state, county, political subdivision or any other publicly funded organization shall not implement any action that restricts a person’s rights or that the Office of the Attorney General or the Legislature by a majority vote determines to be unconstitutional.

Federal law always trumps state law, but any federal action that is unconstitutional is not a law at all. For example, even some things that Congress can do by passing a federal law are unconstitutional if a president tries to do without Congress passing a law.

Oklahoma House Speaker Charles McCall and State Rep. Mark McBride, both Republicans, introduced the bill, which passed in the House 79-18.

If some states had done this during the Trump administration, the MSM would have gone wild with approval.

For all I can remember, maybe some states did.

This is a start, but there is a flaw in the OK legislature’s plan. It is certain that there will be a craven OK AG that will determine that some cockamanie edict from the illegitimate DC junta is “constitutional” and should be implemented. Then what will the legislature do? The legislature itself should rule on any edict issued from the DC junta.

And another thing...the article claims “federal law always trumps state law” except when a federal law is deemed to be outside the scope of the constitution. Well then, why does OK, or any other state, continue to allow the DC junta to force adherence to unfettered abortion, involuntary euthanasia, discriminatory affirmative action, homosexusl pseudo-marriage, and so much more that is clearly in contravention of the constitution? Because both the Marxocrats and GOPee quisling traitors do not care a whit about adherence to the constitution. These scumbags of both parties have utterly failed to hold the DC junta to account for any of their illegal and illegitimate actions for decades. Why would anyone think the OK politicians of either party would require adherence to the constitution now? The answer is “They won’t!”

It’s like a city deciding which laws to accept about deported violent convicted felons who are illegally in town. Or takeovers by BLM and Antifa CHOP activists barring Americans from freely entering or leaving part of their own country.

Are you a dissident?
I imagine most will not even bother to read the article in the link. Taking 30-40 minutes away from the Kardashians is difficult. Besides it is NASCAR season. You have to read this article more than once to get the full impact. Thought provoking which is another detractor.
Very thought provoking and instructive! The top of the article states “24 minute read.” It is not. It is probably more like 35 minutes of going back and forth and reading certain key paragraphs two and three times in order to let the author’s points sink in.
That said I feel this is an essential article in that it is a realistic appraisal of where we are and what the author thinks needs to be done going forward. I tend to agree with him. Do not attempt to read it unless you have a block of time to read this uninterrupted; time where you can think and digest the paragraph you just read before moving to the next paragraph. This is not something you can skim your way through.
Without giving away the article, let me say that the Trump Presidency has had little to do, one way or the other, with the perilous situation we find ourselves in. Our current condition has been building at least since the election of Woodrow Wilson and probably way before that.
