Expulsion, Exclusion, Disqualification, Impeachment, Pardons: How They Fit Together

The clauses in the Constitution governing expulsion and exclusion from Congress, impeachment, disqualification from public office, and pardons are obscure and have rarely been interpreted by Congress or the courts. Yet these clauses are interrelated and can lead to striking and provocative conclusions. Any member of Congress who assisted the Jan. 6 assault on the Capitol can be not only expelled from Congress but also excluded upon reelection. Short of conviction by the Senate in the impeachment trial, former President Trump can be disqualified from holding any federal or state office if the Senate makes a finding of fact that he engaged in the Jan. 6 insurrection. And, perhaps most strikingly, pardons issued and the bills signed by Trump after Jan. 6 are constitutionally invalid. (excerpt)

Should the former President Trump chuck his legal team as dolts and embark upon bringing down the Senate himself, these are the considerations regarding their departure and possible return. He can start this off at the hearing by attacking the authority of Harris to preside as President of the Senate due to her unnatural Us-born citizen status. Then he can address the Senators who voted to certify her as VP. Then turn to Biden, and note he was instrumental in the presentation of an unqualified VP, an election fraud, and they can start impeaching Biden, instead. That leaves Trump as the winning candidate who is fully qualified to serve, with Pence.

So then he’s retroactively impeached?

Cart before the horse Democrat lawyers

None of this including the impeachment would pass muster at the Supreme Court if they look at the Constitution. Then again neither does Biden “victory” in which election law was changed by people OTHER than the legislature and unequal standards were applied within battleground states.

The author is incorrect. Jan. 20 is a US President's last official day, and the next US President's first day.

The author is incorrect.

Facts don't matter to rat lawyers or rat law professors. They are partisans with no core moral values.
