Still looking in the constitution for the requirement that the Federal Government concern itself with the education of the citizens of the individual states. Why does the 10th amendment not apply here? Way too much Federal overreach and big-daddy overreach in this and many other areas. The Office of Education began in 1887 when “impeached” (that seems to be in vogue these days) President Andrew Johnson created it as an advisory department to collect data and “help” the states set up their own educational systems. It wasn’t until Jimmy Carter’s administration that this became a Cabinet level department. Prior to this LBJ signed the elementary and Secondary Education Act which basically preempted the state’s role in education.
The 14th amendment’s equal protection guarantee is used to justify more and more federal control, which is used to “Trump” the 10th amendment’s restriction of Federal authority.
Basically, the Federal government can find a way to usurp State’s rights anytime the Federal power-hungry players decide they want to do so.
