The Arizona Senate is set to pass a contempt resolution finding that the Maricopa County Board has failed to comply with a subpoena demanding access to elections equipment and ballots cast in the November election, with the potential threat of arrest alluded to in the sure-to-pass resolution.
The Senate introduced the resolution Wednesday afternoon. Timing on a full Senate vote is unclear, but all 16 Republican senators are listed as sponsors, meaning it is virtually certain to pass.
If the resolution is enacted, the five members of the county board could be arrested for failing to comply. It authorizes Senate President Karen Fann to take “all legal action” needed to enforce the subpoena.

That the President of the Arizona Senate take all legal action pursuant to section 41-1153, Arizona Revised Statutes, to enforce the subpoena.
A. If a witness neglects or refuses to obey a legislative subpoena, or, appearing, neglects or refuses to testify, the senate or the house may, by resolution entered in the journal, commit him for contempt.
B. A witness neglecting or refusing to attend in obedience to a subpoena may be arrested by the sergeant-at-arms and brought before the senate or house upon authority of a copy of the resolution signed by the president or speaker, and countersigned by the secretary or chief clerk.

The Senate has demanded access to voting machines and all 2.1 million ballots cast in the election. The board has said it can’t comply because ballots are sealed by law and the voting machines the Senate wants to examine need to remain secure.
Board Chairman Jack Sellers said Wednesday he was frustrated that the Senate was threatening to find the board in contempt, saying he met personally with Senate President Karen Fann and thought both sides agreed to try to settle the issue.
“I want to be clear: the county will participate in any court hearing with the Senate if they plan to argue the restrictions on ballots should be waived,” Sellers said in a statement. “Instead of suggesting that we are violating the laws the Legislature wrote, they should turn their attention to finding a solution.
“If they truly believe in the legality of their position, they will join us in seeking a solution through the courts,” Sellers said.
Historic! Most secure election ever! Most transparent officials ever! Nothing to see here, move along (you smelly peons).
Whenever I read something like this I can’t help but think of that scene in the movie “Demolition Man”, when the San Angeles Police Department attempts to confront Simon Phoenix (Wesley Snipes).
Other than having something really dirty to hide, I can’t find any goo reason for the Maricopa County Board not to comply with the subpoena.
If they believe that the election was fair and honest, they should be seeing this as a chance to demonstrate this fact once and for all to all naysayers by being transparent.
Ditto for Detroit, Atl., and Phi.
This should have happened a long time ago.
What I don’t get is this — Arizona’s Senate is Republican, BUT THE MARICOPA BOARD THAT REFUSED TO COMPLY WITH THE SUBPOENA IS ALSO REPUBLICAN DOMINATED!
There must be two Republican wings in this state ( one perhaps is the McCain-Flake wing and this is the one that controls Maricopa).
Instead of suggesting that we are violating the laws the Legislature wrote, they should turn their attention to finding a solution.

Mr. Sellers, you dumbass, a subpoena is not an invitation!
What your trying but failing to accomplish is called “obfuscation”.
The board's response is insane.
What is the purpose for sealing the ballots? Are they sealed to preserve what they contain?
How can you perform an audit of the vote count without checking each and every ballot cast in the election? The purpose of sealing by law is to preserve the ballots for such an audit.
How can you perform a forensic audit of the voting machines without access?
The board is correct to keep the machines secure so they can be subject to examination without tampering before the examination.
What is the board trying to hide with their nonsensical logic for refusing to cooperate?
Deep audits and forensic analyses should be standard operating procedure to maintain election integrity.
And trying to discover whether or not there was fraud and if so, where it occurred *IS* part of the solution. Some people are either too dense or too dishonest that they can’t see things for what they are.
The most transparent election ever!
Are they going to write a sternly worded letter?

There is no need to check machines or audit ballots
Ditto that for PA, MI and GA. The Dems have fought tooth and nail to prevent anyone from looking into a single question about the election. The MSM waves its hand and says "none of these questions has any merit so no need to look."
That alone tells anyone with an ounce of common sense that the election was rotten to the core.

The court already told the legislature they can take custody of the entire election property. They’re taking their their time.
