Certain non-citizen categories have the legal right to work in the US. Permanent residents being one.

Musk is going to lose on this issue.

“The charge alleges that on or about March 10, 2020, during the Charging Party’s interview for the position of Technology Strategy Associate, SpaceX made inquiries about his citizenship status and ultimately failed to hire him for the position because he is not a U.S. citizen or lawful permanent resident,” DOJ attorney Lisa Sandoval wrote in a court document filed Thursday.

It sounds like he isn’t a citizen and is not legally here.

Yes.

However, the article states ‘he is not a U.S. citizen or lawful permanent resident’. That’s why I copied that section of the article.

Until told otherwise, I’m assuming the person is an illegal alien.

SpaceX has numerous US military projects. Employees working on these must pass Background Investigations.

Before an honest judge, Musk wins.
