The one reason to try this is because if successful, everything Biden does, every EO he revokes, every person he appoints to office, is void ab initio. So no need to start from scratch. I doubt SCOTUS will go for it, and if it is filed in the U.S. District Court in D.C., it will probably get assigned to Judge Sullivan just for spite. So, its worth one last try, but it is a long shot and has never even been tried before.
