He’s a kid. But I wasn’t aware that taking a photo with a Proud Boy is a crime. From what I’ve read about that group they are not a violent racist group. Politically incorrect with some kooky members.

All this while showing the photo.

Opening statements do not have to have an ounce of proof or evidence in them. They are merely a narrative of the case.

Plus this will be all over the news. It may never come up in the case, but a member of the jury might have this “fuzzy image” of Kyle, underage, in a bar with someone they heard was a “crazy militia guy.”

No, you are right. None of this was illegal (being in a bar might have been, but a minor issue). But it adds to the impression of a child who is not following the rules, and who is hanging out with “sketchy” people.

That stuff DOES matter when you are awaiting trial.
